Procedure for processing and protecting personal data of CIFROMUSE service users

This Privacy Policy defines the policy regarding the processing of personal data received by the Operator from Users as a result of using the CIFROMUSE digital service, and also contains information about the implemented requirements for the protection of personal data, hereinafter – Policy.

TERMS AND DEFINITIONS

1.1. Affiliated persons — any persons related to the Operator or directly connected with it.

1.2. Personal data — any information received by the Operator from the User, relating to them and allowing identification: account data, Profile data, feedback form data, etc.

1.3. Processing of personal data — any actions with personal data, including collection, recording, systematization, storage, modification, retrieval, use, transfer, blocking, deletion, destruction.

1.4. Operator — Individual Entrepreneur Minin Denis Sergeevich, OGRNIP 320265100036451, INN 263214960952 - Administration of the CIFROMUSE digital service.

1.5. User — a capable individual (including self-employed) or legal entity, individual entrepreneur, their representatives, who have an account and use the CIFROMUSE digital service.

1.6. CIFROMUSE digital service — a website at: https://cifromuse.ru and its subdomains, containing main sections: Main page, Login, Distribution, Singles, Albums, Statistics, Royalties, My Profile, Drafts, FAQ, Support, etc.

GENERAL PROVISIONS

2.1. The Policy governs the processing of personal data of Users obtained during registration, profile filling, feedback forms and other interactions with the Operator.

2.2. This Policy is published at: https://cifromuse.ru

2.3. By using the CIFROMUSE digital service, the User expresses their agreement with the terms of the Policy and gives consent to the processing of personal data, which is an integral part of this Policy.

2.4. If you disagree with the terms of the Policy, use of the CIFROMUSE digital service must be immediately discontinued.

2.5. The Policy was developed in accordance with the Constitution of the Russian Federation and Federal Law No. 152-FZ of July 27, 2006 "On Personal Data".

PURPOSES OF PERSONAL DATA PROCESSING

3.1. Personal data is processed for the following purposes:

  • 3.1.1. Use of the CIFROMUSE digital service by the User, access to Distribution, Statistics and other materials, ensuring Royalty payments.
  • 3.1.2. Organization of creative and commercial cooperation between the Operator and the User.
  • 3.1.3. Execution of the public offer agreement concluded with the Operator, to which the User is a party.
  • 3.1.4. Sending the User informational, advertising and marketing newsletters about features, updates and new functions of the CIFROMUSE digital service.
  • 3.1.5. Collection and provision of information to organizations managing collective copyright and neighboring rights.
  • 3.1.6. Providing customer support on using the CIFROMUSE digital service.
  • 3.1.7. Ensuring maximum possible security of the User account, including through special authentication.
  • 3.1.8. Protection of the rights and commercial interests of the Operator, as well as the rights of counterparties and affiliated persons, if such arise.
  • 3.1.9. Maintaining technical statistics of CIFROMUSE digital service usage, server diagnostics, administration.
  • 3.1.10. Responding to requests from authorized authorities of the Russian Federation.
  • 3.1.11. Execution of a court or other act subject to mandatory enforcement.
  • 3.1.12. Other cases provided for by the legislation of the Russian Federation.

3.2. Personal data may be used for other purposes if required by the legislation of the Russian Federation.

3.3. Processing of personal data is limited to achieving specific, predetermined and legitimate purposes.

COMPOSITION OF PROCESSED DATA

4.1. The Operator, as necessary to fulfill its obligations within cooperation with the User, may request and process the following personal data of the User:

  • 4.1.1. last name, first name, patronymic;
  • 4.1.2. email address;
  • 4.1.3. passport data (series and number, issuing authority details, date of issue);
  • 4.1.4. registration address and actual (postal) address;
  • 4.1.5. Tax Identification Number (INN);
  • 4.1.6. Individual Insurance Account Number (SNILS);
  • 4.1.7. mobile phone number;
  • 4.1.8. bank details (account number, servicing organization, SBP);
  • 4.1.9. login and password for the account;
  • 4.1.10. additional security contact (phone number or email);
  • 4.1.11. IP address;
  • 4.1.12. browser data: MAC address, device type, screen resolution, OS version, browser type and version;
  • 4.1.14. Yandex.Metrica data (per terms at https://yandex.ru/legal/metrica_termsofuse/);
  • 4.1.15. other data necessary for concluding and/or executing contracts, including offer agreements with the Operator.

4.2. The User agrees not to provide third-party data without obtaining their written consent.

4.3. The Operator does not deliberately collect special categories of personal data (racial origin, political views, health status, etc.), but may process them if the User independently posted such data on the CIFROMUSE digital service.

USER RIGHTS

5.1. The User has the right to:

  • 5.1.4. Access information relating to their personal data processed by the Operator.
  • 5.1.5. Make changes and clarifications to personal data, delete personal data posted on the CIFROMUSE digital service.
  • 5.1.6. Request changes and clarifications of personal data from the Operator.
  • 5.1.7. Demand notification of all persons who were previously provided with incorrect or incomplete personal data.
  • 5.1.8. Receive from the Operator information regarding the processing of personal data.
  • 5.1.9. Demand destruction of all or part of personal data, and also withdraw consent to their processing. The User should keep in mind that data deletion or withdrawal of consent may result in inability to use all or some functions of the CIFROMUSE digital service.

PERSONAL DATA PROTECTION

6.1. When processing personal data, the Operator takes necessary legal, organizational and technical measures, in particular:

  • 6.1.4. appointment of a person responsible for personal data processing, if required by the Operator;
  • 6.1.5. limiting the number of employees with access to personal data, if required by the Operator;
  • 6.1.6. user identification and tracking of their actions;
  • 6.1.7. antivirus control and other protection measures against malicious impact;
  • 6.1.8. data backup and recovery;
  • 6.1.9. software updates as needed.

CONFIDENTIALITY

7.1. The Operator and other persons who have gained access to personal data are obliged not to disclose or distribute them without the User's consent, except in cases provided for by law.

DESTRUCTION OF PERSONAL DATA

8.1. Destruction of the User's personal data is carried out in the following cases:

  • 8.1.1. upon achievement of processing purposes or loss of necessity within no more than 30 days, unless otherwise provided by the offer agreement;
  • 8.1.2. upon detection of unlawful processing of personal data within no more than 10 business days;
  • 8.1.3. upon expiration of the personal data storage period determined in accordance with Russian legislation, including withdrawal of processing consent;
  • 8.1.4. upon order of the authorized body for protection of personal data subjects' rights, the Russian Prosecutor's Office or court decision.

TRANSFER TO THIRD PARTIES

9.1. When storing personal data, the Operator uses databases located in the Russian Federation.

9.2. Only with written consent may the Operator transfer personal data to the following third parties:

  • 9.2.1. third-party contractors / partners involved in the development and operation of the CIFROMUSE digital service;
  • 9.2.2. providers of hosting, web analytics and technical support services;
  • 9.2.3. providers of marketing, advertising and analytics services;
  • 9.2.4. other third parties specified in the Subject's Consent to personal data processing;
  • 9.2.5. upon request — to inquiry and investigation bodies, other authorized bodies on grounds provided for by Russian Federation legislation.

CROSS-BORDER TRANSFER

10.1. The Operator does not carry out cross-border transfer of personal data without the User's consent.

10.2. Before commencing cross-border transfer, the Operator must ensure that the foreign state provides adequate protection of personal data subjects' rights.

10.3. Cross-border transfer to states not providing adequate protection may only be carried out with the User's written consent or to fulfill a contract to which they are a party.

FINAL PROVISIONS

11.1. The period of personal data processing equals the period of fulfillment of the Operator's obligations or until withdrawal of consent by the User, or cessation of the Operator's activities.

11.2. Withdrawal of consent is carried out by the User or their representative sending a written application to the Operator.

11.3. The Policy is subject to amendment and supplementation in case of new legislative acts on processing and protection of personal data, as well as at the Operator's discretion.

11.4. The Policy may be amended by the Operator at any time without special notification. The new version comes into force from the moment of publication on the CIFROMUSE digital service. Regular review of the current version is the User's responsibility.

11.5. Issues not regulated by the Policy are governed by the current legislation of the Russian Federation.
